The general conditions of contract govern the distance selling relationship between PERE CORNELLÀ S.A.U. and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998, of April 13, on General Conditions of Contract, Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defence of Consumers and Users, the current regulations on the Protection of Personal Data, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce.

PERE CORNELLÀ S.A.U. reserves the right to make any amendments it deems appropriate, without notice, to the General Conditions. Said amendments may be made, through its websites, by any form admissible in law and shall be binding during the time they are published on the website and until they are validly amended by subsequent ones. However, PERE CORNELLÀ S.A.U. reserves the right to apply, in certain cases, Special Conditions of Contract in preference to these General Conditions when it deems appropriate, announcing them in due time and form.

The purpose of the website is the sale of coffee beans and related products, such as tableware and accessories.

The duration of the contract shall be linked to the delivery of the product without prejudice to the right of withdrawal.

As a user or customer you expressly declare that you know, understand and accept the conditions of use and these general conditions of purchase. Similarly, you declare that you are of legal age and have the legal capacity and competence to access PERE CORNELLÀ S.A.U. websites and to enter into contracts through the same.

To purchase our products, you can go to the relevant section of our online store.

Once the purchase process is complete, the customer will receive a confirmation of said purchase by email. It is imperative that during the purchase process the user indicate a valid email address. The customer, upon receipt of the product at the delivery address provided, will receive a copy of the order placed.

 

Sales and period of validity

If a product is on sale, this will always be indicated next to its essential characteristics, the sale price and the period of validity of the sale.

In compliance with current regulations PERE CORNELLÀ S.A.U. provides information on all items for sale, as well as the features and prices thereof. However, PERE CORNELLÀ S.A.U. reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of said website. In this way, the products offered at any given moment through the website shall be governed by the General Conditions of Contract in force in each case. Additionally, the company shall have the power to stop offering, without notice and at any time, access to the products mentioned.

 

Essential characteristics of the products

The products offered on our online store include a photograph and the essential characteristics of the same, which is the information obtained from the manufacturer itself. The colour of the product, observable in the photograph is not binding. In the characteristics the same is identified.

 

Guarantees

PERE CORNELLÀ S.A.U. is responsible for non-conformities of all products offered on the website for a period of 18 months from delivery. PERE CORNELLÀ S.A.U. has an after-sales service for the indicated period. Prices

All products indicate the selling price in euros and include Value Added Tax (VAT).

If any other tax is applicable, this would be indicated (IGIC, the General Indirect Canary Islands Tax, or IPSI, the Tax on Production, Services and Imports).

 

Delivery and transport costs

PERE CORNELLÀ S.A.U. ships to the Iberian Peninsula. Shipments are free for orders over €30 not allowing a purchase below that amount..

PERE CORNELLÀ S.A.U. will deliver the order within approximately 48-72 HOURS. The courier company used will be GLS.

 

Payment methods and fulfilment of the order

The customer may pay the amount of his or her order by Visa, Mastercard or Maestro credit card.

All transactions involving the transfer of personal or banking data are carried out using a secure environment, a server based on the standard security technology SSL (Secure Socket Layer). All the information you transfer to us travels encrypted through the network.

Furthermore, your credit card details are entered directly on the bank’s website, at the POS (Point of Sale Terminal of the Bank) and are not entered or recorded on any PERE CORNELLÀ S.A.U. servers.

When paying with a VISA, MASTERCARD or MAESTRO card, you will always be asked for the following information: the card number, the expiration date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your VISA, MASTERCARD or MAESTRO card, thus offering more guarantees regarding the security of the transaction.

This form of payment is valid only on the website.

If the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and credit entries in the accounts of the supplier and the cardholder shall be made as soon as possible.

However, if the purchase was indeed made by the cardholder and the demand for a refund is not the result of having exercised the right of withdrawal or termination and, therefore, the cardholder unduly demanded the cancellation of the corresponding charge, he or she shall have to pay all expenses incurred by PERE CORNELLÀ S.A.U. occurring as a consequence of the cancellation.

The availability of the products offered by PERE CORNELLÀ S.A.U. may vary depending on customer demand. Although PERE CORNELLÀ S.A.U. restocks the inventory periodically, the product requested by the customer may be out of stock at that moment. In the event that the order is not fulfilled due to unavailability, PERE CORNELLÀ S.A.U. shall notify the customer as soon as it is aware of this situation, by email or phone call. The period of this communication shall under no circumstances exceed a maximum period of 30 days. PERE CORNELLÀ S.A.U. may give two options: providing the customer, without an increase in price, with a product of similar characteristics or superior quality, or, unless there are reasons justified and demonstrable by PERE CORNELLÀ S.A.U., within this same period reimbursing the sums paid for the cancelled order.

 

Right of withdrawal, returns and claims

Right of Withdrawal

The buyer shall have a period of fourteen calendar days to withdraw, from the day the customer receives the product, without penalty and without indicating the reasons.

According to the provisions of Article 103 of Law 3/2014 of March 27 amending the consolidated text of the General Law for the Defence of Consumers and Users, the supply of services or goods made according to consumer specifications or clearly customised, or that, by their nature, can not be returned or may deteriorate or expire rapidly, are exempt from withdrawal.

 

Returns

The customer will be required to contact PERE CORNELLÀ S.A.U., at the telephone number 972476300 or by email to hola@mahoganyspecialtycoffee.comto inform of the reason for the return. PERE CORNELLÀ S.A.U. may accept or reject the reason for the return. In th event that it is accepted by PERE CORNELLÀ S.A.U., we will indicate where to send the product. The return costs are borne by the customer. Once the product has been received and it has been verified that it is in perfect condition, the corresponding amount will be refunded.

Without undue delay, and in any event within a maximum period of fourteen calendar days from the date on which the right of withdrawal of the contract is formalised. It shall be understood that the deadline has been met if the customer returns the product before the end of the same.

 

Refund of payment

The refund of the amounts received by the customer shall be carried out using the same means of payment used by the customer, unless otherwise provided.

PERE CORNELLÀ S.A.U. may withhold the refund until it has received the product, reason for withdrawal, or until the customer provides proof of return of the product, depending on which condition is met first.

 

Return of a defective product

.In the event that the product is not in good condition and the causes of this are not attributable to the customer, the customer shall be entitled to return the product, informing PERE CORNELLÀ S.A.U. of the reason for return through any of the means provided in these conditions of contract, and at no cost to the customer. A return by reason of defect or poor condition of the product shall not be considered a right of withdrawal.

PERE CORNELLÀ S.A.U. undertakes to bear the cost of the return and to exchange the product for a new one in accordance with conditions accepted at the time of sale.

Jurisdiction

Additionally, PERE CORNELLÀ S.A.U. reserves the right to file civil or criminal actions it deems appropriate for the misuse of its website and content or for breach of these conditions.

The relationship between the user and the provider shall be governed by the regulations in force and applicable in the Spanish territory. If any dispute arises, the parties may submit their disputes to arbitration or have recourse to the ordinary courts in compliance with the rules on jurisdiction and competence in this regard. PERE CORNELLÀ S.A.U. has its registered office in Fornells de la Selva, Spain.

 

ELECTRONIC INVOICING CLAUSE

In accordance with the provisions of current regulations on Personal Data Protection, we inform you that your personal data will be entered in a file under the responsibility of PERE CORNELLÀ S.A.U., in order to meet the commitments arising from the relationship we have with you.

If you do not inform us otherwise within 30 days, we will understand that your data have not been modified, that you commit to notifying us of any change and that we have your consent to process them in order to process your billing.
